These Terms & Conditions ("Terms") govern your use of the services provided by X by Z ("we," "us," or "our"), an experience design studio operated by Zach Strohmeyer in Atlanta, Georgia. By engaging X by Z or using our website, trip pages, intake forms, or any related applications (collectively, "Services"), you agree to these Terms.
X by Z designs travel and celebration experiences, including itinerary design, hotel reservations through our partner network, vendor coordination, and curated welcome materials. We are not a travel agency in the traditional sense; we are an experience design studio. We coordinate reservations and arrangements with third-party suppliers (hotels, restaurants, transportation providers, etc.) on your behalf, but those underlying services are provided by those third parties subject to their own terms and conditions.
Our SMS program sends transactional and operational text messages to clients regarding their trips and experiences. This includes urgent updates, schedule changes, coordination details, reminders, and reservation confirmations. The program also sends internal operational alerts to the business owner.
By providing your mobile phone number through any X by Z intake form or trip-related interface, you expressly consent to receive these SMS messages.
Message frequency varies based on your trip and current activity. There is no fixed cadence; we send messages only as needed.
Message and data rates may apply per your mobile carrier plan. X by Z does not charge for SMS messages.
The X by Z SMS program supports major US carriers (AT&T, Verizon, T-Mobile, and others). Carriers are not liable for delayed or undelivered messages.
We do not share your phone number with third parties for marketing purposes. See our Privacy Policy for full details on how we handle your information.
Specific scope, deliverables, fees, payment schedule, and cancellation terms for an engagement are set out in a separate proposal or agreement provided to each client at the start of the engagement. In case of conflict between these Terms and a specific engagement agreement, the engagement agreement controls for that engagement.
Payments are processed through Stripe. By submitting payment, you authorize the charge as described in the proposal or invoice. Refunds, when applicable, follow the cancellation terms of the specific engagement agreement.
Hotels, restaurants, ground transportation, activities, and other services we coordinate are operated by independent third parties. While we exercise care in selecting and recommending suppliers, X by Z is not responsible for the actions, omissions, or service quality of any third-party supplier. We will advocate on your behalf to resolve issues but cannot guarantee outcomes outside our control.
We strongly recommend that all clients purchase travel insurance for any trip. X by Z does not provide insurance and is not liable for trip interruptions, cancellations, medical events, lost belongings, or other risks that travel insurance is designed to cover.
You agree not to misuse our website, trip pages, or related tools. This includes attempting to access systems or data you are not authorized to access, scraping, reverse-engineering, or interfering with the operation of the Services. We reserve the right to revoke access for any user who violates these Terms.
All content, copy, design, branding, code, and trip materials produced by X by Z are the intellectual property of X by Z. Trip-specific deliverables (proposals, itineraries, welcome kits) are licensed to you for personal use related to your engagement. You may not republish, resell, or commercially redistribute X by Z materials without written permission.
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, X by Z disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, X by Z's total cumulative liability arising from or related to the Services is limited to the fees you have paid X by Z directly for the engagement in question. X by Z is not liable for indirect, incidental, consequential, or punitive damages.
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. The "Effective" date at the top reflects the most recent version. Continued use of the Services after a change constitutes acceptance of the updated Terms.
